Abstract
El presente artículo tiene como objetivo analizar el marco jurídico que ofrece el derecho internacional humanitario cuando el Estado realiza acciones que afectan a niños, niñas y adolescentes reclutados ilegalmente por grupos armados, en el desarrollo de conflictos armados no internacionales. Se analiza el dilema que surge a raíz del reclutamiento de menores, como crimen en el marco del derecho penal internacional, versus el rol que se les asigna, como combatientes, a esos menores, según los convenios y protocolos de Ginebra. Además, se estudian diferentes pronunciamientos judiciales respecto a los niños soldados como participantes civiles de hostilidades y las limitaciones prácticas de considerarlos ya sea combatientes o civiles hostiles. En ese sentido, una importante limitación es cómo el contexto particular y las mismas normas sobre el derecho de guerra imponen obligaciones a las partes de actuar con proporcionalidad. Finalmente, se concluye que, aunque exista vaguedad jurídica frente al ataque a niños, niñas y adolescentes soldados en el derecho internacional humanitario, es menester atender las múltiples consecuencias de este hecho y propender a proponer soluciones para limitar esta vaguedad.
