En examinant le continuum juridico-psychiatrique québécois, cet article propose de considérer l’expérience de la désinstitutionalisation psychiatrique en tant que précédent abolitionniste. L’histoire des institutions psychiatriques québécoises est traversée par des mouvements de résistance et de recul de la carcéralité, en particulier face au modèle asilaire et par l’antipsychiatrie. Cette histoire est également marquée par une expérience concrète de désinstitutionalisation (ou « déshospitalisation »), entendu comme un mouvement de fermetures massives et définitives d’institutions d’hébergement et d'hôpitaux psychiatriques, qui prend place dans les années 1950-1970. À l’échelle nord-américaine, et dans le contexte du tournant néolibéral, cette expérience de désinstitutionalisation des personnes psychiatrisées et en situation de handicap est présentée à tort comme l’une des causes de l’explosion de l’itinérance et de l’incarcération de masse des personnes psychiatrisées. Nous soutiendrons que cette expérience constitue néanmoins un précédent abolitionniste pouvant être (ré)investi dans une perspective émancipatrice. Au-delà de l’abolition comme processus de transformation sociale ou comme superposition de réformes non-réformistes, nous soutiendrons que cette expérience permet d'intégrer la notion de rupture institutionnelle à la théorie et à la praxis abolitionniste.
