A partir des années 2000, de nouvelles politiques nutritionnelles émergent en France, notamment autour du Programme National Nutrition Santé (PNNS) afin d’agir sur l’alimentation des Français et réduire les pathologies chroniques (cardiovasculaires, diabète, obésité) (Séguy, 2014 ; Boubal, 2018). Ces politiques sont depuis régulièrement traversées par des controverses concernant à la fois la sécurité sanitaire (listeria, dioxine, vache folle, OGM) et la qualité nutritionnelle (taxe, étiquetage) (Borraz, 2008 ; Benamouzig, Blanck, 2023). Dans ce contexte, les acteurs de la santé mettent en avant différentes modalités d’action pour agir à la fois sur les comportements des consommateurs et sur l’offre alimentaire, suivant une logique de gouvernement des conduites (Dubuisson-Quellier, 2016 ; Dubuisson-Quellier, 2017 ; Dubuisson-Quellier, Granier, 2019). Parmi celles-ci, ils proposent de réguler davantage la publicité alimentaire pour réduire l’exposition des enfants aux stratégies marketing des industriels de l’agroalimentaire (Boubal, 2018). Mais à chaque tentative, ils font face à une opposition massive et systématique des acteurs économiques de l’agroalimentaire et de la publicité, qui s’allient pour bloquer toute initiative publique sur ce domaine. Pourtant l’effet néfaste de la publicité semble scientifiquement démontré : de nombreux experts produisent régulièrement des rapports dans lesquels ils font ce constat et appellent à une régulation plus contraignante : notamment l’OMS1, l’INSERM2, le HCSP3, l’IGAS4, la Cour des comptes et Santé Publique France. Et de nombreux pays ont déjà mis en œuvre des mesures pour encadrer davantage la publicité alimentaire : le Royaume-Uni, le Québec, la Norvège, l’Irlande, le Chili ou encore le Mexique.
