Abstract
Penelitian ini mengkaji perlindungan hukum bagi penumpang yang mengalami gangguan kesehatan mendadak selama penerbangan, baik dari perspektif hukum nasional maupun internasional. Meskipun terdapat regulasi yang memadai seperti Undang-Undang Nomor 1 Tahun 2009 tentang Penerbangan dan berbagai Peraturan Menteri Perhubungan, serta konvensi internasional seperti Konvensi Warsawa 1929 dan Konvensi Montreal 1999, implementasi dari regulasi tersebut masih memiliki celah yang dapat menghambat efektivitas perlindungan hukum. Penelitian ini mengidentifikasi beberapa masalah utama seperti kurangnya pengawasan dan penegakan hukum, ketidakjelasan standar layanan medis, dan kurangnya pelatihan awak pesawat dalam menangani situasi medis darurat. Dengan menganalisis celah-celah ini, penelitian ini memberikan rekomendasi untuk memperbaiki implementasi regulasi, meningkatkan kejelasan standar layanan medis, dan memperluas pelatihan untuk awak pesawat. Dengan demikian, penelitian ini bertujuan untuk meningkatkan tanggung jawab maskapai penerbangan dalam situasi darurat medis di udara, serta menciptakan pengalaman perjalanan udara yang lebih aman dan nyaman bagi semua penumpang.
