Los anclajes del art. 23.1 CE: el referéndum consultivo autonómico como vía de profundización democrática

Abstract
La ciudadanía tiene derecho a participar en asuntos públicos, directa o indirectamente (art. 23 CE), y el art. 92 CE permite someter decisiones trascendentes a referéndum consultivo. Sin embargo, ni este artículo ni su normativa definen claramente su alcance, plazos o requisitos, dejando margen para consultas autonómicas o locales respaldadas por el art. 149.1.32ª CE. Estatutos de Autonomía de “segunda generación” han asumido competencias en consultas populares, como la Ley 9/2008 del Parlamento Vasco y el art. 122 de la Ley Orgánica 6/2006 en Cataluña, abriendo espacio para fortalecer la democracia directa. El artículo analiza las capacidades autonómicas en referéndums, la evolución constitucional de estas consultas y el papel del Tribunal Constitucional en su consolidación democrática.
