Abstract
Im Vertragsrecht des SGB VIII, IX und XII haben die prospektiv zu vereinbarenden Entgelte eine zentrale Funktion. Im Zusammenhang mit diesen Entgelten führt das sogenannte Rückwirkungsverbot, das im Vertragsrecht nach dem SGB VIII, IX und XII zu beachten ist, immer wieder zu erheblichen Unsicherheiten. Es kursieren verschiedene praktische Auslegungen der Regelungen zum Rückwirkungsverbot, die sich vor allem zumeist nur an den Ergebnissen orientieren, die sich auf die eine oder andere Weise erreichen lassen. Mit diesem Werk unternimmt der Autor, den Versuch, dem Rückwirkungsverbot ein rechtswissenschaftliches Korsett einzuziehen. Die vorliegende Untersuchung, die weitgehend von der herrschenden, diffusen Meinung abweicht, soll die Diskussion anregen und Klarheit zum Rückwirkungsverbot schaffen.
