Abstract
Au Canada, il n’existe aucune infraction criminelle spécifique pour quiconque tue ou blesse un foetus au cours d’un crime à l’encontre d’une femme enceinte. Depuis plusieurs années, des projets de loi sont régulièrement déposés au Parlement pour pallier cette situation en modifiant le Code criminel afin de protéger les enfants à naître, notamment par la création de nouvelles infractions ou la codification à titre de facteur aggravant le fait qu’une victime est enceinte. Une telle loi n’a toutefois jamais été adoptée, car on craint que son entrée en vigueur octroie un statut juridique protégé au foetus, ou le reconnaisse à titre d’être humain, et mine éventuellement le droit à l’avortement. Toutefois, ces craintes ne sont pas fondées. La protection des enfants à naître des crimes à leur encontre ne mettrait pas en péril le droit à l’avortement et ne changerait pas le statut du foetus en droit.
