Abstract
Foreign direct investment from the United States had been subject to a heated debate in its two smaller North American neighbors. By the time the North American Free Trade Agreement (NAFTA) was being negotiated, Canada and Mexico had turned more receptive and liberal in their economic policies. NAFTA marked the first time a chapter dealing thoroughly with investment was included in a trade agreement. Chapter 11 encompassed not only substantive but also procedural provisions for investment protection, notably the investor-state dispute settlement (ISDS) mechanism. Soon, investment trends had not gone as anticipated, nor had the implementation of the ISDS mechanism. The chapter reviews and assesses these key aspects of the evolution from NAFTA 1.0 to the United States–Mexico–Canada Agreement (USMCA) or NAFTA 2.0 as they relate to investment among the three North American partners.
