Abstract
Perkembangan hukum pidana mengikuti pola kehidupan manusia memaksa beberapa tindak pidana harus diatur diluar KUHP sehingga pengaturannya bersifat khusus. Kekhususan ini menyebabkan perlakuannya juga “khusus” sehingga mendiskriminasi hak-hak bersyarat bagi narapidana dengan kasus ini. Hal ini bertentangan dengan UUD 1945 sehingga Undang-Undang Nomor 22 Tahun 2022 tentang Pemasyarakatan lahir sebagai reaksi terhadap diskriminasi ini. Penegasan asas nondiskriminasi dilakukan demi mewujudkan tujuan awal pemasyarakatan. Lapas Narkotika Bangli dipilih sebagai locus penelitian untuk mengetahui implikasi nondiskriminasi pemberian hak bersyarat kepada narapidana narkotika. Penelitian ini merupakan penelitian yuridis empiris yang bersifat deskriptif. Jenis data yang digunakan adalah data primer data sekunder. Teknik pengumpulan data melalui teknik wawancara dan studi kepustakaan dengan teknik pengolahan data secara kualitatif. Penerapan nondiskriminasi pemberian hak bersyarat di Lapas Narkotika Bangli belum dapat diterapkan secara maksimal akibat keterlambatan pemenuhan syarat administrasi oleh petugas sehingga diskriminasi waktu pemberian. Implikasinya dapat dilihat dari sisi positif dan negatif. Dari sisi positif terjadi penurunan overkapasitas walaupun tidak signifikan, tidak adanya gangguan keamanan dan ketertiban dan peningkatan indeks kepuasan masyarakat. Implikasi negatifnya adalah peningkatan beban kerja petugas dalam memenuhi syarat administratif akibat minimnya jumlah petugas dan tingginya jumlah narapidana yang memenuhi syarat
