Les composantes de l’obligation de protection <i>in situ</i> de la biodiversité en droit international de l’environnement*

Abstract
Cet article fait suite à une précédente recherche, laquelle a permis de dégager l’existence d’une obligation de protection in situ de la biodiversité en droit international de l’environnement, incombant aux États en raison de leurs engagements internationaux. Il propose de décliner plus finement les composantes d’une telle obligation. En vue de cet objectif, il procède à une analyse positiviste des principaux instruments juridiques internationaux et régionaux de protection in situ de la biodiversité, complétée par une analyse doctrinale. Les résultats de l’analyse permettent de mieux comprendre le rôle fort attendu des États dans la protection des éléments de la biodiversité sur l’ensemble de leurs territoires nationaux et au-delà, particulièrement dans le contexte actuel de crise écologique planétaire. L’article démontre ainsi qu’il est attendu des États qu’ils protègent la biodiversité se trouvant sous leur juridiction selon des principes de durabilité et de façon à ne pas causer des dommages environnementaux en dehors de leurs frontières.
