Since October 2023, the US-led Western imperial alliance has provided military, economic, and diplomatic support that has been essential to Israel’s ability to carry out its genocidal operation. The USA sees Israel as a critical imperial outpost, and many countries in the Global South are increasingly situating Palestine as an ideological fault line between them and the imperial West. Among other arenas, the fault line is evident at the International Court of Justice, where South Africa has charged Israel with genocide and where the Court has held hearings regarding the legality of Israel’s occupation of the Palestinian territories. The article examines the two cases as part of a counter-hegemonic campaign waged by Global South states against US imperialism and Israeli settler colonialism. Though it came with critical limitations, the Court’s advisory opinion in favour of Palestinian self-determination shows that increasingly, US hegemony is not what it used to be, with the Global South becoming more pronounced in its challenge to US-led Western imperialism. The article concludes that situating the Palestinian struggle for liberation within a global decolonial and anti-imperial struggle is critical in reaching not only a just resolution for Palestinians but also in transforming the international order.
