This chapter attempts to understand the regulation of dangerous sports by way of their statutory oversight, the approach in the law of torts (by way of negligence) or under domestic criminal law. The chapter highlights that the tradition in common law countries (UK, Ireland, US, Canada, Australia, New Zealand etc.) is that sports operate by way of self-regulation. In such countries, sports have a longstanding freedom or autonomy to regulate their affairs. The ‘licence’ that such sports have can be described as a social licence i.e., so long as standard practices in that sport meet community expectations, then that sport&s;s ability to regulate itself is respected. This type of license has been replaced in more recent years by quasi-statutory regulation whereby in order to be recognised as the national controlling body for a sport—the gateway to the receipt of government support and funding—sports must meet certain governance and financial standards.
