هذه الرسالة دراسة فقهية تناولت موضوع: (التمويل الإسلامي من خلال شراء المسكن بكندا: دراسة فقهية تطبيقية). جاء هذا البحث ليطرح إشكالية عدم وضوح شرعية عقود وصيغ التمويل التي تتعامل بها بعض المؤسسات الإسلامية الصغيرة من أجل شراء المسكن في كندا، إما من جانب نوع العقود والعيوب التي تعتري بنودها، أو من جانب شبهات حول مصادر التمويل التي تعتمد عليها، ثم تطرق الباحث إلى الإجابة عن أسئلة حول أنواع عقود التمويل الإسلامي ومواصفاتها الشرعية، وحول التكييفات الفقهية لصيغ التمويل لتصلح عقودا لشراء المسكن، وعن أسئلة حول أنواع عقود التمويل الإسلامي المستعملة من طرف المؤسسات التي اختيرت نماذج للدراسة، ومدى خضوع شروطها وبنودها للمواصفات الشرعية. وتهدف هذه الدراسة إلى توضيح مقاصد الشريعة في المعاملات المالية وبيان مواصفات العقد الشرعي المعتمد لدى الفقهاء، بالإضافة إلى عرض ومناقشة أقوال الفقهاء المعاصرين حول عقود شراء المسكن وإبراز مدى موافقة البدائل المعروضة في كندا للشريعة، وأقربها إلى روح الشريعة ومقاصدها وأجلاها للشبهات وأرفعها للحرج والمشقة. ولقد اعتمد البحث على المنهج الاستقرائي لجرد لأنواع المعاملات المالية الشرعية المتكيفة مع التمويل الإسلامي لشراء المسكن، مع عرض الآراء الفقهية حولها ومحاولة تحليلها وذكر النصوص الشرعية ومعانيها المتعلقة بها وترجيح المسائل الخلافية إن أمكن. كما اتبع الباحث المنهج الوصفي التحليلي من خلال الدراسة الفقهية التطبيقية لشركات التمويل المختارة. بالإضافة إلى أدوات البحث النظري من خلال الاعتماد على البحوث والمراجع. أما البحث الميداني فقد تجسد من خلال القيام بزيارة المؤسسات للإطلاع على مختلف البيانات والوثائق المتعلقة بجانب صيغ العقود والمعاملات، وإجراء المقابلات الشخصية مع بعض العملاء أو أحد أطراف التعاقد. ومن الجانب الإجرائي، قام الباحث بتحليل المعلومات المُحصل عليها من المؤسسات التمويلية وعرضها على آراء الفقهاء مع بيان محل النزاع فيها بعد استقصاء أدلة الآراء وتوثيقها من مصادرها الأصلية، واستنباط النتائج والتوصيات منها. وفي الأخير عرض الباحث النتائج التي أفضى اليها بعد الاستقصاء والتدقيق وبَيَّنَ حقيقة هذه المؤسسات المالية ومدى شرعية التعامل معها، وقدم بعض الإقتراحات لتصحيح عقودها وبعض التوصيات لتكييف تعاملاتها مع الشرع الإسلامي. والحمد لله رب العالمين.
