More on Sexual Abuse by Priests and the Liability Actions against the Holy See ABSTRACT: Judgment No. 244 of 2024 of the Court of Ascoli Piceno held that an action for damages brought against the Holy See for indirect liability under Article 2049 of the Italian Civil Code, in the context of a case of alleged sexual abuse between a bishop and an adult person, was not covered by immunity from Italian jurisdiction. This article starts with a review of the recent jurisprudence of Australia, the United Kingdom, Canada and the United States of America on the issue of indirect or vicarious liability in the case of sexual abuse by clergy; it then considers the novelty of the legal principle upheld by the Court, which for the first time, in Italy, has addressed, in this matter, the issue of the Holy See’s immunity as a sovereign entity similar to foreign States. SOMMARIO: 1. Una nuova pronunzia (la prima in Italia) sulla proponibilità di azioni di risarcimento nei confronti della Santa Sede per gli abusi sessuali del clero - 2. Una panoramica della più recente giurisprudenza straniera in tema di responsabilità delle autorità ecclesiastiche superiori per gli atti di abuso sessuale commessi dal clero: a) l’emergere di contrapposte posizioni sulla sussistenza della responsabilità indiretta nella common law australiana rispetto a quella del Regno Unito e del Canada - 3. (segue): b) il permanere della preferenza per l’imputazione della responsabilità come conseguenza di una condotta negligent nel prevalente orientamento delle corti statunitensi - 4. (segue): c) la ribadita improponibilità da parte della giurisprudenza statunitense di azioni di risarcimento nei confronti della Santa Sede - 5. L’„approccio italiano” alla questione dell’immunità nella sentenza del Tribunale di Ascoli Piceno: a) i limiti del criterio “logico” di trattazione delle questioni applicato a una fattispecie di agevole soluzione nel merito - 6. (segue): b) le questioni di rito concernenti l’identificazione del soggetto convenuto in giudizio - 7. (segue): c) gli snodi dell’iter argomentativo del giudice circa la questione della sussistenza della giurisdizione - 8.
