Abstract
L’article examine les règles complexes régissant le transfert et la mise en garantie des titres intermédiés en droit québécois, en mettant particulièrement l’accent sur les transferts impliquant des portefeuilles de titres diversifiés émis par des émetteurs situés dans plusieurs juridictions. Ces règles demeurent obscures pour les investisseurs et les praticiens et ce, malgré leur impact significatif sur le droit de propriété des titulaires des titres. Le texte explore, à la lueur du droit comparé, les termes clés utilisés par le législateur québécois, tout en éclairant leur application pratique à travers des exemples concrets.
