La regresividad de la Corte Constitucional. La quimera en derecho laboral

Abstract
El Derecho fundamental del fuero de maternidad alcanzó el nivel de protección más alto en la Sentencia SU-070/13 de la Corte Constitucional, sin embargo, a través de la Sentencia SU-075/18 esta corporación disminuyó las garantías en la parte subjetiva del derecho en lo que respecta a las prestaciones de las mujeres gestantes, vulnerando así, el principio de progresividad y no regresividad el cual se encuentra consagrado en la Convención Americana de Derechos Humanos en los artículos 2 y 26 específicamente, de la cual es parte el Estado de Colombia, por tal razón es menester cuestionar si ¿está facultada la Corte Constitucional para disminuir la protección de estos Derechos? El derecho al trabajo de las mujeres en embarazo debe garantizarse, igualmente, debe tenerse en cuenta que son empleadas que tienen necesidades diferentes de los demás trabajadores, y la normatividad nacional e internacional, así lo regula. La Constitución Política estableció el control de convencionalidad, cuando existan actuaciones y disposiciones legales que vayan en contra de los tratados ratificados por el Estado en materia de Derechos Fundamentales lo que implica que el Estado colombiano, podría caer en responsabilidad por hecho ilícito al vulnerar, en este caso, el Derecho fundamental del fuero de maternidad.
