HAVA YOLUYLA YÜK VE YOLCU TAŞIMA DAVALARINDA TÜRK MAHKEMELERİNİN MİLLETLERARASI YETKİSİ

Abstract
Çalışmamızda, uluslararası taşıma sözleşmelerinden doğan davalarda yetkili mahkemeler, milletlerarası özel hukuk çerçevesinde değerlendirilmektedir. Bu bağlamda konu, Türkiye’nin taraf olduğu milletlerarası anlaşmalar ve bu anlaşmaların uygulama alanına girmeyen durumlarda ise MÖHUK hükümleri çerçevesinde değerlendirilmektedir. Varşova ve Montreal Konvansiyonları, çok geniş katılımın sağlandığı milletlerarası anlaşmalar olduğundan taşıyanın hukukî sorumluluğuna ilişkin davalar bu Konvansiyonlara dayanılarak çözümlenmektedir. Diğer taraftan, kalkış veya varış yerlerinden birinin Türkiye, diğerinin ise milletlerarası anlaşmalara taraf olmayan bir devlet olması durumunda MÖHUK hükümleri uygulama alanı bulabilmektedir. Bu hâllerde, taşıyanın sorumluluk davalarında Türk mahkemelerinin milletlerarası yetkisi MÖHUK’un ilgili hükümlerine göre tayin edilecektir. Ayrıca, Konvansiyonların kapsamına girmeyen hususlarda da MÖHUK hükümleri uygulanacaktır. Bu hususlar, kanunlar ihtilâfı hükümleri dâhil olmak üzere lex fori’ye tâbidir. Dolayısıyla Türk mahkemelerinin, Konvansiyonlar çerçevesinde milletlerarası yetkili olduğu haller MÖHUK hükümlerine göre tayin edilecektir.
