Abstract
Cet article interroge les cadres légaux canadiens et internationaux en matière de rapatriement d’objets et de revendications territoriales autochtones, tous organisés autour de la dimension collective des droits, une dimension qui structure les demandes de rapatriement et les processus de revendication territoriale, au détriment de pratiques normatives locales plus complexes. Il questionne l’état du droit par l’entremise de données produites dans le cadre d’un projet de recherche qui a permis de mettre en lumière la relation entretenue par une famille, membre de la communauté ilnu de Mashteuiatsh (Lac-Saint-Jean, Québec, Canada), avec un objet : un teuehikan (tambour). Ce cas sous-tend un rapport à l’objet et un régime normatif de propriété ilnu relationnel, un rapport effacé par le régime actuel de propriété collective.
