Abstract
Abstract This chapter explains the extension of patent terms and the use of supplementary protection certificates (SPCs) across major jurisdictions, noting important differences and common principles. It describes Australia’s detailed requirements for pharmaceutical patent extensions, recognises Canada's prohibition on term extensions but its acceptance of overlapping claims, and confirms that China and India disallow both extensions and SPCs. The chapter examines Japan’s system allowing extensions due to regulatory delays and the United States’ dual framework for extensions under regulatory review and Patent Office delays. It also analyses the European Union’s SPC regime, which compensates for lost patent time due to marketing authorisation procedures and explores national SPC practices in countries like France and Germany. Finally, the chapter underscores how regulatory approval timing and legal interpretation critically shape the granting and contesting of extensions.
