Abstract
Abstract This chapter illustrates the biologicals regulatory approval process. A product is considered a biological medicine if its active substance is produced by or extracted from antibodies, enzymes, hormones, or some other biological source. Australia’s Therapeutic Goods Administration (TGA), unlike the US Food and Drug Administration, operates on the basis that therapeutic products are therapeutic products no matter how they are derived. Accordingly, each new biological product applying for registration will be assessed in the same way a new pharmaceutical product would be, without extensive dichotomies to determine procedures. The chapter then looks at the Biologics and Genetic Therapies Directorate (BGTD) in Canada; the regulatory approval process in India and Japan; and the biologics licence application under the Public Health Service Act (PHS Act) in the United States. Chinese laws do not provide particularly for the biological regulatory approval process, which is generally understood as the same as the process for pharmaceuticals. Finally, the chapter considers the biologicals regulatory approval process in Europe, particularly in France, Germany, Italy, the Netherlands, and the United Kingdom.
