Abstract
Abstract This chapter provides an overview of the regulatory process for each of the jurisdictions dealt with in this text. Each of the jurisdictions covered here have a government regulatory body to oversee the approval and registration of certain types of products which must meet certain quality standards. Correspondingly, each jurisdiction has enacted a range of laws to empower the regulatory authority to undertake appropriate reviews and make decisions in relation to regulatory approval and monitoring of products. The laws of each of the European jurisdictions covered in this text are based on a common European instrument, the Community Code. The regulatory authorities may also at least partially administer patent linkage processes where they exist, such as in Australia, Canada, and the United States. In general, a company wishing to market a pharmaceutical product must establish that it is safe and effective. These requirements are the twin touchstones of the entire regulatory process. The same principles apply to applications for approval of medical devices, agricultural chemicals, and biological products as for pharmaceuticals. In relation to biological drugs, in a very general sense, the main point of difference is that in many countries there is still no clearly defined route for follow-on biological products to gain approval.
