Abstract
Abstract This chapter discusses data exclusivity regimes for pharmaceuticals across Australia, Canada, China, India, Japan, and the United States. Australia offers a single data exclusivity regime, with no separate protection for new indications, paediatric indications, or orphan drugs, while Canada provides eight years of data protection for innovative drugs. It details Japan’s extension of post-marketing surveillance terms, offering up to ten years of exclusivity for paediatric indications, and the United States' three-year exclusivity under the Hatch-Waxman Amendments. The chapter highlights the Federal Food, Drug, and Cosmetic (FDC) Act’s provisions for paediatric exclusivity and orphan drug exclusivity, which offer extended exclusivity for conducting paediatric studies and developing drugs for rare diseases, respectively. It covers European incentives for new therapeutic indications and the requirements for extending data exclusivity.
