Abstract This chapter examines how different jurisdictions approach disclosure of patents to industry standard-setting organizations (SSOs), especially in relation to competition law and intellectual property rights. It highlights Australia’s concern with patent ambushing, where companies hide essential patents during the standard-setting process, undermining the fair, reasonable and non-discriminatory (FRAND) framework. It also explains that such conduct can distort standards, inflate consumer prices, and trigger royalty-stacking in high-tech sectors. The chapter discusses Canada that permits refusal to license even when technology defines an industry standard, as exercising intellectual property rights is seen as part of a market economy. Japan’s Standardization Guidelines and the United States' focus on SSOs in sectors like electronics, biotechnology, and pharmaceuticals reflect similar regulatory attention, while China and India offer limited or no express rules on disclosure obligations in the standard-setting context.
