Abstract
Abstract This chapter examines disclosure obligations to patent offices across major jurisdictions. Australia mandates disclosure of search results but now removes the obligation due to compliance difficulties. Canada enforces disclosure when the Examiner requisitions prior art and maintains an evolving duty of candour. China and India impose mandatory disclosure related to foreign applications and penalise failures. Japan requires applicants to disclose relevant known publications at the time of filing, while the United States imposes a strict duty of candour, obliging disclosure of all material information to preserve patent enforceability. Europe, including France, Germany, Italy, the Netherlands, and the United Kingdom, generally imposes no legal duty, although France and the United Kingdom create risks for patentees who knowingly fail to disclose crucial prior art. Finally, the chapter stresses that timely and accurate disclosure is essential for maintaining strong patent rights globally.
