Abstract
Abstract This chapter explores how regulatory and legal frameworks in Australia, Canada, the US, and Europe influence data protection, patent listing, and market exclusivity strategies used by innovator pharmaceutical companies. Australian law now requires innovators to specifically identify ‘protected information’ within their Therapeutic Goods Administration dossiers. It examines Canadian practices under the Patented Medicines (Notice of Compliance) Regulations, where innovators previously engaged in ‘evergreening’ by repeatedly listing patents through NDS or SNDS filings. The chapter explains that generics must present their full case from the start, since repeating arguments later may be seen as an abuse of process. It covers the use of citizen petitions in the US under 21 CFR § 10.30 and the limitations imposed by FDC Act § 505(q).
