Abstract
Abstract This chapter examines how various jurisdictions address the competition implications of settlement agreements in the context of patent disputes. It notes that while Australia's Trade Practices Act 1974 targets restrictive trade practices, Canada's Competition Act still applies to privately negotiated settlements, which may be scrutinised if complaints are lodged. In China, the exercise of intellectual property rights is generally protected, but compulsory licence may be imposed if such exercise constitutes a monopoly. India currently has no specific competition rules on litigation settlements and Japan commonly includes non-contest obligation clauses in settlement terms, which are not typically seen as competition issues. The chapter mentions the United States and the European Union that recognise that certain patent settlements can raise serious antitrust concerns, with EU law applying Articles 101 and 102 of the TFEU when such agreements affect trade between Member States.
