Abstract This chapter evaluates third party intervention during prosecution of a patent application. The theory behind this is to enable the patent office to obtain the best possible information from which to make a decision about whether to grant a patent and the scope of the monopoly so conferred. However, the extent to which a third party may participate is limited. In Australia, Canada, China, the European Patent Office, France, Germany, Japan, and the United States, the third party may only notify the patent office of the grounds of the objection and will take no further role in the examination process. There is no provision for such intervention in India, Italy, or the Netherlands. The procedure in the United States is of little use to third parties because it must occur prior to publication of the patent application and third parties are almost never aware of the existence of the patent application prior to publication.
