Abstract This chapter explains court hierarchies and appeal routes. All the jurisdictions dealt with in this text have at least one level of appeal open to disputes concerning intellectual property. Some have two and others have three appeals possible, depending on the forum for the first instance decision. Some jurisdictions such as China, Japan, the United Kingdom, Germany, the United States, and the Netherlands have specialist courts set up specifically to deal with intellectual property matters. Others, such as Australia and Canada, have particular courts and particular judges within them who tend to hear most intellectual property cases. In Germany and China, the patent office has exclusive jurisdiction to hear nullity or revocation proceedings at first instance. Invalidity has at best a limited application as a defence to infringement in such jurisdictions.
