Abstract
Abstract This chapter discusses various strategies used by pharmaceutical companies to manage patent term extensions and regulatory approvals across multiple countries. It explains how Australian companies often delay seeking regulatory approval to benefit from the country's patent term extension regime. It also outlines Canadian regulations that offer an eight-year data protection term and strategies like withdrawing products from the market to prevent generic competitors from obtaining approval. The chapter covers Japan's strategies, including Notification No 0331009, which eases marketing approval for combination drugs, and its post-marketing surveillance regulations that extend clinical trials for paediatric indications up to ten years. It discusses the U.S. Food and Drug Administration's (FDA) accelerated approval process, which allows for faster approval of drugs for serious illnesses based on surrogate endpoints or restricted use conditions.
