Abstract
Abstract This chapter illustrates the technology transfer arrangements of Australia, Canada, China, India, Japan, and the United States in the context of intellectual property and competition law. It explains how Australia covers the mechanisms and legal agreements used for technology transfer in the pharmaceutical industry. In Canada, the Competition Act applies to technology licensing, which is generally seen as economically beneficial unless it creates or enhances market power. It also notes that China regulates technology transfer under several laws and requires written contracts for transfers and licensing. The chapter highlights the restrictive clauses in patent licensing agreements in India that are void under the Patents Act, while the Competition Act prohibits conduct that limits technical or scientific development. Japan’s Guidelines and the United States’ 1995 Intellectual Property Guidelines define an antitrust ‘safety zone’ for licensing conduct.
