Abstract
Abstract This chapter outlines how Australia, Canada, China, and India each provide a legal basis for recognising intellectual property as an exception to competition (anti-trust) law. It explains how the Trade Practices Act 1974 in Australia regulates a wide range of anticompetitive conduct, using both per se provisions and the SLC test. In Canada, intellectual property rights are defined by federal statutes such as the Patent Act and Trade-marks Act, with courts treating patents as contracts between the state and inventor in exchange for full disclosure. It also describes how China's Anti-Monopoly Law of the PRC prohibits abuse of intellectual property rights that eliminate or restrict competition, while still permitting their lawful use. The chapter highlights India’s unique approach, where competition aspects are embedded directly within its intellectual property statutes, including provisions for compulsory licensing.
