Abstract
Abstract This chapter examines the concept of the skilled addressee across Australia, Canada, China, India, Japan, the United States, and Europe, emphasising its pivotal role in patent law. Courts in Australia and Canada treat the skilled addressee as a hypothetical, non-inventive yet knowledgeable person, while China and India describe this figure as accessing all common knowledge without exercising creativity. Japan, the United States, and parts of Europe sometimes expand the concept to a skilled team, especially for interdisciplinary inventions. France, Germany, Italy, the Netherlands, and the United Kingdom refine the skilled addressee’s traits, combining technical competence with a lack of inventive imagination to assess inventive step and disclosure. Finally, the chapter demonstrates how this fictional construct maintains an objective standard for patent interpretation across diverse legal systems.
