Abstract This chapter outlines the rules and practices governing patent amendments across Australia, Canada, China, India, Japan, the United States, Europe, and specific European countries. It explains that in Australia, complete specifications may be amended at any time during a patent’s life, subject to formal procedures, while Canada offers voluntary amendment mechanisms such as reissue, disclaimer, re-examination, and clerical correction, each with specific restrictions. In China, patent owners may amend claims only during invalidation proceedings, while India permits amendments under the Controller’s supervision or in courts during infringement and revocation cases. Japan allows amendments during the application process, appeals, and trials for correction or invalidation, whereas in the United States, amendments must occur through reissue, re-examination, or certificates of correction. Finally, the chapter examines European practice, where amendments may occur before grant or post-grant through limitation or revocation requests under the European Patent Convention (EPC), and details national approaches in France, Germany, Italy, the Netherlands, and the United Kingdom.
