Abstract
Abstract This chapter addresses court actions commenced to invalidate a patent, which may be called revocation proceedings, nullification proceedings, or impeachment proceedings. They may be commenced as the first action in a dispute or they may be added as a cross-claim (counterclaim) as a defensive response to an infringement proceedings. In general, the widest possible range of invalidity grounds in each jurisdiction is made available for invalidity proceedings. This is to ensure that once in court the validity of the patent in question is fully tested. The procedure applicable to invalidity proceedings varies quite dramatically between jurisdictions. In some jurisdictions any person may at any time commence an invalidity proceeding. However, in others such as Canada, Italy, and the United States, one must establish standing to bring an action. In the United States, the action must take the form of a declaratory judgment action. The forum for invalidity proceedings may be a court, such as in Australia, Canada, France, India, Italy, or the Netherlands, or it may be in a specialized forum which may be administered by the patent office as in China, Germany, and Japan. Although an invalidity proceeding in the Netherlands is before the court, if it concerns a Dutch (as opposed to EPO) patent, it must be commenced with an advisory report from the Dutch Patent Office concerning the applicability of the grounds for invalidation.
