Abstract This chapter explains how trade mark protection is structured in various jurisdictions, focusing on both registered and unregistered rights. In Australia, trade marks can be protected under common law or by registering under the Trade Marks Act 1995, while in Canada, a registered trade mark gives the owner exclusive rights across the country, with protection extended to certification marks and distinguishing guises. It describes visual signs such as words, designs, or colour combinations in China that are registrable. It also notes India’s protection of registered trademarks from infringement, while unregistered marks can pursue passing off claims. The chapter covers Japan that follows a first-to-file system under its Trade Mark Law, where rights arise only upon registration. In the United States, trade mark rights prevent the use of confusingly similar signs in commerce and provide a clear path to federal registration through the USPTO.
