Abstract
Abstract This chapter examines amended specifications, reissue applications, and certificates of correction. The opportunities for post-grant amendment vary across the jurisdictions of Australia, Canada, China, India, Japan, the United States, France, Germany, Italy, the Netherlands, and the United Kingdom. In some jurisdictions, such as Canada and the United States, there are specific procedures applicable to specific situations, such as reissue patents, disclaimers, re-examination, and certificates of correction. In general, the reissue procedure is intended to be the mechanism by which defective patents are corrected. Re-examination provides an opportunity for fresh prior art to be considered by the patent office. Disclaimers enable a patentee to disclaim subject matter inadvertently incorporated into claim scope. Meanwhile, certificates of correction are intended for the correction of trivial errors which in essence are self-evident. Ultimately, time limits apply in making certain of these applications and also affect the nature of the application that can be made.
