Abstract
Abstract This chapter examines Canada’s legal framework for protecting major events and intellectual property, beginning with an introduction and the special Olympic protection in the Definition of a Major Event section. It outlines trade mark law—from definition, application, examination, opposition, prohibited marks, registrability, distinctiveness, renewal, non-use, infringement, exceptions and dilution to criminal sanctions and passing off—and covers assignment, licensing and parallel trade. The chapter explores copyright law, covering registration, qualifying works, originality and fixation, authorship and ownership, qualification, duration, infringement and defences. It surveys design protection, including application, novelty, ownership, duration, infringement, defences and special protection of Olympic and Paralympic symbols and association rights. Finally, the chapter addresses advertising regulation under the Competition Act and Advertising Standards Canada, reviews Winter Olympics 2010 measures, and examines ticket resale, contracts and ticket reselling provisions.
