Abstract
تعد الثورة الالكترونية من اهم معالم العصر الحالي والتي القت بضلالها على جميع نواحي الحياة ومن بينها اثرها على مرفق مهم من مرافق المجتمع الا وهو مرفق القضاء من خلال ظهور المحاكم الالكترونية، فقد ساهمت الظروف الصحية الحالية على تشجيع الاتجاه بالأخذ بهذا النظام، فكانت تلك التغييرات الحياتية الدافع نحو ظهور هذا النوع من المحاكم. وبالتالي اصبح من الضروري اعادة النظر في تطبيق النظام القضائي التقليدي، واستبداله بنظام قضائي حديث من خلال استخدام التكنولوجيا في المنظومة القضائية، وذلك لضمان حسن سير مرفق العدالة، وتسريع مختلف الاجراءات القضائية، وضمان جودة المعلومات، تماشياً مع التطور السريع، ويعد التقاضي الإلكتروني من اهم تطبيقات التكنولوجيا الحديثة في مجال العدالة والذي يثير جملة من الاشكالات القانونية والتطبيقية في مختلف الدول.
