Abstract
Comment associer la copropriété divise, une modalité plurale de la propriété individuelle, et le cohabitat, une modalité communautaire d’habitation? Le modèle de la copropriété divise est principalement investi par des promoteurs immobiliers privés dont les intérêts financiers sont éloignés de l’intérêt collectif de la copropriété, représenté par son syndicat, et des intérêts individuels des futurs copropriétaires. Le modèle du cohabitat, en associant au projet communautaire les futurs habitants, permettrait‑il de réconcilier la copropriété divise avec sa fonction d’habiter un lieu? À travers l’étude de deux projets implantés au Québec, Cohabitat Québec et Cohabitat Neuville, cet article dévoile l’existence d’un modèle hybride d’habitat participatif qui, combinant coopérative et copropriété divise, met en place une structure collective de propriété. Doté d’un arsenal de règles contraignantes et de valeurs communautaires fortes, ce modèle juridique crée des (mi)lieux de vie au service d’une communauté d’habitants… à moins que la réalité ne soit plutôt une communauté d’habitants au service des lieux.
