Abstract
En droit québécois, la personne physique qui contracte avec un entrepreneur en construction ou un promoteur immobilier, que ce soit pour acheter une maison neuve ou une unité d’un immeuble à usage d’habitation ou encore pour faire construire, rénover, réparer ou entretenir un bâtiment résidentiel, bien qu’elle soit un consommateur, ne bénéficie que d’une mince protection sur le plan juridique. Dans le présent article, nous exposons d’abord de quelle façon l’encadrement légal et réglementaire actuel est marqué d’incohérences et s’avère insuffisant à assurer la protection de ce consommateur immobilier. Par la suite, nous cherchons à poser les premiers jalons d’une éventuelle loi sur la protection du consommateur immobilier en définissant les principes qui devraient guider son élaboration ainsi que les règles particulières et les mesures de protection ciblées qui devraient y être incluses.
