Abstract
Afin de répondre aux difficultés d’accès au logement au Québec, certaines coopératives d’habitation ont recours à l’usufruit à titre onéreux pour offrir à leurs membres un mécanisme de capitalisation individuelle. Bien que cette approche soit louable, elle pose des défis d’ordre fiscal. En effet, la Loi de l’impôt sur le revenu du Canada considère l’usufruit québécois comme une fiducie, transformant ainsi sa conceptualisation sur le plan fiscal et entraînant des conséquences inattendues, particulièrement lorsque l’usufruit est à titre onéreux. Ce texte propose une réflexion critique sur la manière dont l’usufruit à titre onéreux du droit civil québécois est perçu et traité dans le système fiscal canadien. Cette analyse vise à encourager une réévaluation du traitement fiscal de l’usufruit québécois et son adaptation aux réalités sociales et juridiques actuelles.
