Abstract
Sauf empêchement, les conjoints de fait qui deviennent parents du même enfant dès le 30 juin 2025 entreront en « union parentale ». Dans le texte qui suit, l’auteur vise à éclairer les débats que suscitera l’application d’un élément clé de ce nouveau régime protecteur, soit la possibilité pour l’un des conjoints de réclamer à l’autre une prestation compensatoire. Ce recours s’inscrit entre un mécanisme du même nom du droit matrimonial et celui qui existe en matière d’enrichissement injustifié du régime des obligations, tel qu’il a été adapté par les tribunaux à la spécificité de l’union de fait. Malgré certains signaux contraires, y compris un commentaire du ministre de la Justice du Québec lors du parcours législatif, la réforme ne peut raisonnablement priver les conjoints en union parentale d’un recours dont jouissent les conjoints de fait selon le droit commun. En revanche, en vue d’intégrer la prestation compensatoire d’union parentale dans le droit civil du Québec, l’auteur l’interpréterait afin de consolider et de rendre plus accessibles les acquis prétoriens en matière d’enrichissement injustifié dans le contexte de l’union de fait.
