Abstract
Le libelle diffamatoire criminel est source d’un conflit fondamental qui oppose le droit à la liberté d’expression et les principes sous-jacents, lesquels ont été exprimés sous diverses formes depuis la fin du XVIIIe siècle. La politique consistant à recourir au droit criminel pour décourager les formes d’expression préjudiciables, au motif qu’elles portaient atteinte à la réputation de la victime, a évolué progressivement au fil des ans. Mais depuis les années 1990, des pressions importantes sont exercées dans le monde occidental et au Canada pour que des réformes soient mises en oeuvre. L’auteur, s’inspirant de l’oeuvre et de la pensée de Jean-Denis Archambault, tout en lui rendant hommage, propose qu’il revient au droit civil public, c’est-à-dire au droit civil dans ses interactions avec le droit public, de se définir et surtout de se développer sous l’inspiration du droit international des droits de la personne, afin de définir les situations où le libre exercice de la parole porte atteinte à d’autres intérêts, comme le respect de la vie privée et de la dignité.
