Abstract
MgO-pladerne var uegnede som vindspærreplader i Danmark, fordi de optog fugt fra luften.Brugen af MgO-plader har afstedkommet et meget stort antal voldgiftssager, hvoraf flere stadig verserer.Der er imidlertid truffet afgørelse i nogle vigtige principielle sager om, hvem der hæfter eller bærer ansvaret for MgO-pladernes manglende anvendelighed.Indtil videre er følgende kendelser om ansvar for MG-plader offentliggjort: TBB 2017 779 VBA, TBB 2018 907 VBA, og T:BB 2019 369 VBA.Kendelsen T:BB 2019 151 VBA pålagde en underentreprenør ansvar for at bruge MGO-plader, men med den begrundelse, at underentreprenørens valg af MGO-plader var i strid med den indgåede aftale, der foreskrev vindspærreplader i fibercement.Yderligere er der på dette tidspunkt af Voldgiftsnævnet for bygge-og anlægsvirksomhed afsagt to utrykte (ikke offentliggjorte) voldgiftskendelser i sagerne C-14199 (7.maj 2019) og c-14452 (5.juli 2019).
