Abstract
Bogen omhandler den offentlige forvaltnings brug af aftaler til varetagelse af myndighedsopgaver over for borgere med særligt fokus på aftaler om eller i tilknytning til myndighedsudøvelse. Eksempelvis kan nævnes ejendomshandler under ekspropriationstrussel, forligsmæssig bilæggelse af skattetvister og kommunale udbygningsaftaler. Sådanne aftaler – forvaltningskontrakter – aktualiserer en lang række almene og særegne juridiske problemstillinger, der kun i begrænset omfang har været undersøgt tidligere. Bogens teoretiske bidrag indeholder en kritisk analyse af den traditionelle sondring mellem offentlig ret og privatret samt en præsentation af forvaltningskontrakten som juridisk fænomen, der er udbredt i praksis, og som påkalder sig særskilt retsvidenskabelig interesse. Med afsæt heri gennemføres en række studier af forvaltningskontrakternes indgåelse og retsvirkninger fordelt på følgende tematikker: Materielle indgåelsesbetingelser, kompetence, aftaleindgåelsesproces, bindingsvirkning og ændringsadgang, fortolkning, tredjepartsspørgsmål, sanktionering, ugyldighed samt tvistløsning/kontrol. Dermed introduceres og analyseres talrige konkrete problemstillinger af praktisk og teoretisk interesse, som forvaltningskontrakterne giver anledning tid. Analyserne giver samlet set grundlag for at konkludere, at der i vidt omfang kan identificeres almindelige normer angående forvaltningskontrakter, der henter næring fra både forvaltningsretlige og kontraktsretlige forestillinger. Dermed tegnes konturerne af en almindelig forvaltningskontraktsret.
