Abstract
Artiklen er en kommentar til to nyere artikler i Juristen af henholdsvis Helle lsager m.fl. og Hanne Hartoft vedrørende kommuners erstatningsansvar for brud på EMRK artikel 3. Først fastslås, at der - modsat hvad der hævdes i artiklerne - gælder et objektivt ansvar for brud på menneskerettigheder, hvilket følger af den nyere højesteretsdom i U 2017.2929 H. Herefter gøres der nogle kritiske bemærkninger til de betragtninger om passivitet og ansvarssubjektivitet, der fremføres i førstnævnte artikel af Helle lsager m.fl.
