Abstract
Teniendo en cuenta la desigualdad social racializada histórica de Brasil, este ensayo examina si la Constitución Ciudadana de 1988 ha influido en la construcción de políticas migratorias basadas en los derechos fundamentales y las demandas de los movimientos sociales de migrantes, refugiados y apátridas, y en qué medida lo ha hecho. Con este f in, trazamos los retos, los logros y los obstáculos para formular políticas basadas en la noción de los migrantes como sujetos de derechos frente al brutalismo del actual capitalismo neoliberal, el contexto político brasileño más amplio y la construcción de un nuevo régimen mundial de control de la migración.
