La promesse de plus de transparence sur les usages des pesticides répandus à proximité des lieux d’habitation a été dépendante en France de l’élaboration et de la mise en œuvre des chartes départementales des riverains, dont le feuilleton normatif et judiciaire a été fourni depuis 2019. Si les émissions de pesticides sont couvertes par le droit à l’information environnementale, ce dernier, au bénéficie des riverains, a été globalement voué à l’échec. À l’issue d’une analyse des chartes, des consultations publiques et de 19 entretiens auprès des divers acteurs, cet article met en lumière le fossé existant entre les finalités multiples et ambitieuses attribuées à l’information des riverains et son absence de concrétisation. Par une approche sociojuridique, il révèle combien ce droit, conçu pour le bénéfice des personnes exposées, a été verrouillé par et pour les intérêts du lobby agricole. Il dénonce un désengagement de l’État sur cet enjeu public majeur et une approche néo-libérale des droits à l’information et à la santé au nom de la liberté économique des producteurs.
