Abstract
본 연구는 국내의 금전 판결이 외국 법원, 특히 미국, 캐나다, 호주에서 승인 및 집행되는 과정을 분석하고, 주요 실무적 쟁점과 대응 방안을 고찰하였다. 이를 위하여 외국 재판의 승인 문제에 관한 각국의 법제와 법원의 태도를 비교 분석하였다. 미국은 연방 차원의 통일된 법률이 존재하지 않기 때문에, 이른바 모델법인 UFMJRA 및 UFCMJRA를 기반으로, 경우에 따라 주요 판례를 따라 승인 문제를 다루고 있다. 캐나다는 대법원 판례에서 정립된 실질적이고 중대한 관련성(real and substantial connection) 기준을 통해 외국 판결 승인 문제를 판단하지만, 세부적 적용에서는 주별로 차이를 보이고 있어 이를 함께 분석하였다. 호주는 연방법인 외국재판법에 따라 외국 판결의 승인과 집행을 통일적으로 규율하고 있으나, 하위규정인 외국재판규정에 따라 상호주의가 인정되는 대상국을 명시하고 있으며, 우리나라도 그 적용 대상에 포함된다. 본 연구는 특히 예금보험공사의 해외 자산 회수 사례를 토대로, 실제 승인 및 집행 과정에서 발생한 다양한 문제점과 그 해결 방안을 고찰하였다. 미국에서는 공시송달 문제와 이에 대한 소송 전략상 대응 방안을 관련 판례를 통해 구체적으로 분석하였다. 캐나다에서는 원금 대비 과도한 이자의 문제점을, 호주에서는 우리나라와 상이한 항소심 절차가 승인 및 집행에 미치는 실질적 영향을 실제 사례를 중심으로 검토하였다. 아울러 해외 소송비용 부담 문제에 대응하기 위한 전략적 수단으로서 소송금융(litigation funding) 제도의 활용 가능성도 함께 논의하였다. 본 연구는 국내 금전 판결의 외국 법원에서의 승인 및 집행 실무를 개선하고, 관련 제도 정비 논의에 실질적으로 기여할 수 있을 것으로 기대된다.
