Al analizar la existencia de relación de dependencia a los efectos de la tributación por contribuciones especiales de seguridad social, existen casos difíciles, en los que se observa cierta falta de correspondencia entre las formas jurídicas adoptadas por los particulares y la realidad económica subyacente. Respecto a los profesionales universitarios, el art. 105 de la Ley 18.083 establece que no habrá relación de dependencia “cuando así lo determine la libre voluntad de las partes”. A nuestro entender, la realidad social indica que en la enorme mayoría de los casos, cuando el profesional es contratado por una empresa prestadora de servicios profesionales, no se encuentra efectivamente en igualdad de condiciones para negociar el carácter de dependiente o no dependiente de su actividad, por lo que si se cumplen las condiciones generales para ser considerado dependiente, así debería ser tratado desde el punto de vista legal, so pena de afectar el principio de igualdad. Del estudio de la jurisprudencia del TCA, surge que en los casos difíciles, se realiza una cuidadosa ponderación de los variados índices de subordinación aplicables al caso; no obstante lo cual, existen algunos que poseen un mayor peso relativo, que serán analizados en el presente trabajo.
